Can this retailer persecute me? They keep making errors in their shipments.?

There is a famous retailer who is notorious of shipping the wrong items to its customers, mixing up the orders by shipping completely different orders to wrong customers in bulk and sometimes you get your whole order where one or two items are missing. There is 153 1 star reviews about the same complaint about the retailer, so this is a very widespread situation with them. Once I returned stuff to their stores instead of shipping it back and their own employees complaint how the customers get wrong stuff constantly. My only issue is that I have had the same problems constantly plus frequently they would forget to ship something to me form my bulk order but they would always refund me for it by apologizing. So now I found out that they closed my accounts and transferred the accounts to their fraud unit. I'm guessing it's because I notified them of the stuff they were not shipping and Im sure it happens to others too, so this got me worried now. What are the chances of them taking some action against me because aren't theys upposed to prove that the items I say i didn't get were not shipped? Also, they always said sorry and voluntarily refunded me for the missing items, so they wouldn't have grounds to now claim that those items were indeed received right? I am talking about one item missing among let's say 10 items in the same order/box. Once they ended up shipping me a watch, a box, and when my dad opened it, there was no watch! So this goes to show you what I mean.

Prosecute is word word you were looking for, not persecute.

I don't see how they could prosecute you, but if they are suspicious of fraud then they would sensibly transfer the sale to the appropriate department just in case they were being scammed. It's not really in the best interests from a marketing point of view to let their customers know that though. It would certainly put me off from buying there.

The thing I don't understand though, is why you keep buying from this company?
If I consider purchasing product, for example, from an eBay listed company and their rating is below 98%, then I will check out all the negative comments and reasons for customer dissatisfaction.
No matter how good their price is, there's no way it can be worth all this headache and angst to you.

All companies have the right to refuse to do business with an troublesome customer. If that's 'persecution' so be it. If you mean can they prosecute you, no, they can't. Only an attorney general can prosecute. But if their fraud investigation unit has evidence that you've committed fraud they could turn it over to the attorney general and cooperate in their investigation. So knock it off.

I don't see how they are persecuting you if you say you are not the only one complaining about the ineptness of their shipping
if they have closed your account, I don't see how they even have a fraud unit, they are not a police agency(I would assume and they are definitely IRS who does have a fraud unit)

Why did you keep ordering from them if you found them to be terrible and rated one star. Suspicious that you kept ordering and complaining and getting refunds. Sounds like fraud to them and probably anyone else. So as a normal person would have shopped elsewhere, you found the loop hole and continued claiming things till they figured you out and cancelled you.

Can they prosecute you. If they have a fraud unit and you've claimed enuf, yes.
